“Pro bono” is derived from the Latin phrase “pro bono publico,” which means “for the benefit of the public.” It mainly refers to delivering legal services in the public interest by legal experts for free or at a greatly reduced cost, with no prospect of a commercial return. This service can be provided to individuals, charities, or community organisations that cannot afford legal representation and do not qualify for legal aid or other forms of assistance
Pro bono Lawyers:
Pro bono lawyers are usually not compensated for their services. Court expenses and other filing fees may be waived for lawyers who take pro bono cases. In rare situations, an attorney may provide a payment arrangement that enables attorney expenses to be reimbursed if the case is successful. Pro bono programmes assist low-income individuals in locating attorneys who are ready to provide free legal assistance or, in rare cases, conduct a whole case for no charge.
Difference between Legal Aid and Pro bono:
Legal aid is a term that refers to legal help provided by an attorney who works for a government or a non-profit organisation that is supported. The attorney is paid by their organisation or the government, and the client is not liable for paying the attorney’s fees. For example, in Bangladesh, there is the National Legal Aid Services Organisation, operated by the government, which provides legal aid to those in need.
Pro bono assistance, on the other hand, refers to assistance provided by a private lawyer who, whether or not in cooperation with a legal aid agency, performs services without charge. The customer, once again, is not liable for payment. Attorneys vow to help the less disadvantaged as part of their oath, and pro bono work is one method to make sure that occurs.
Why Pro bono:
Pro bono services are critical because they ensure that the most disadvantaged people and families are treated equitably. Many cases in Bangladesh are waiting because people are unable to complete the process owing to a lack of funds. As a result, there is no way to uphold justice. Furthermore, some persons are unable to obtain legal assistance, and as a result, they do not pursue their claims. Pro bono services become a godsend for individuals in need in this circumstance. Pro bono strengthens the image of law firms and the legal profession by assisting individuals, giving access to justice, and maintaining the rule of law in society.
