Admiralty and Maritime Laws are both being used interchangeably in our country. Admiralty law or maritime law is the distinct legal framework (both substantive and procedural) governing navigation and shipping, covering the private international laws & domestic laws. It covers all contracts, torts, injuries, or offenses on navigable waters. Though traditionally focused on oceanic issues, it has expanded to cover any public body of water, including lakes and rivers. These laws broadly cover interactions between two or more ships, the ship captain’s obligations to the crew and passengers, crew members’ rights, cargo & ship discharging, bunker or delayed sailing, other legal issues, etc.
Laws governing Admiralty:
Under ‘The Admiralty Court 2000’ in Bangladesh, all maritime suits are governed. The High Court Division of the Supreme Court of Bangladesh has the original jurisdiction to deal with all admiralty cases, which extended to ships or vessels anchored at any port of Bangladesh.
Also, The regulations for Working at Chittagong Port 2001, The Bangladesh Flag Vessels (Protection) Ordinance 1982, UNCLOS 1982, and UN Maritime & Insurance Regulations are enforceable for Maritime & Admiralty related issues in Bangladesh.
The International Convention relating to Arrest of Seagoing Ship 1952 & the International Convention of the Arrest of Ships 1999 has been ratified by Bangladesh.
Under Income Tax Manual 1984 section 102, 103A, admiralty is practiced.
