How to register a Patent?

Anyone can register a patent application with the Department of Patents, Designs, and Trademarks whether they are Bangladeshi or not. Foreigners should submit their applications through a local Bangladeshi legal firm. The application must be made to the Department of Patents, Designs, and Trademarks (DPDT) and the application forms can be found on the Department of Patents, Designs, and Trademarks of Bangladesh website. The procedure for the registration is as follows:
Step 1: First of all, the applicant has to make a forwarding letter addressed to the registrar of the Department of Patents, Designs, and Trademarks.
Step 2:
Duly filed in the prescribed form (Form-1 or 1A / 2 or 2A as the case may be).
Step 3: Pay the official prescribed fee.
Step 4: Fill out a detailed specification form and, if feasible, add one set of tracing paper design sheets that describe the invention.
Step 5: The patent office will issue an acceptance letter for advertisement following the approval of the patent application. This is usually issued within 18 months of the application being filed.
Step 6: The patent application will then be released to the public for scrutiny. Within four months after the date of the advertising, anybody may file a notice of objection to the award of a patent.
Step 7: If there is any objection, the patent applicant will respond in writing. The Registrar is required to grant Letters Patent (LP) if no opposition is filed within the time period.
Step 8: Pay a prescribed fee in line with Rule 23 of the Patents & Designs Rules 1933 within 24 months or 28 months (as the case may be) from the date of filing to have the patent sealed.
If a priority application is filed, the priority documents must be submitted with it or within 12 (twelve) months after the initial filing date. The standard acceptance deadline for a patent application is 18 (eighteen) months, with a three-month extension from the date of filing. If the application is for a foreigner, a power of attorney (for the applicant’s benefit) must be supplied.
Required Documents:

  1. Title of the invention, the nature of the invention, and the manner in which it is to be performed.
  2. Whether the invention is a product or device or process.
  3. The objective of the invention.
  4. Brief description of the drawings (if any)
  5. A detailed description of the invention with reference to the accompanying drawings (if any)
  6. The novelty of the invention.
  7. Inventive steps of the invention.
  8. Industrial applicability of the invention.

Government Fees:

  1. For provisional specific form – BDT 1,000
  2. Bank Draft –
    • Ordinary application BDT 2,000
    • Priority application BDT 10,000
  3. Complete specification form – BDT 3,000
  4. Sealing Fee – BDT 3,000
